Filing 143 MEMORANDUM DECISION granting 79 Motion for Summary Judgment ; denying 117 Motion for Partial Summary Judgment. Westroc, Inc.s claim under the UUPA was transferred first to Westroc, LLCby operation of the conversion and then to K ilgoreby operation of the MPA. Because Holdco never succeeded to any claims of Westroc, Inc., it could not have assigned them to Spurlino. Accordingly, the court concludes that Spurlino lacks standing to bring his UUPA claim. Count I of Spurlinos Amended Complaint is DISMISSED; and Judgment will be entered in favor of Defendants. Signed by Judge Jill N. Parrish on 8/1/17. (jlw) |
