ORDER RE: UNDERWRITING DISCOVERY: The Court GRANTS Alton Coals motion to depose Senecas 30(b)(6) witness on the issue of underwriting of other highwall miners for five years prior to issuance of the policy at issue and to compel A summary of, or copies of highwall miner policies issued by Seneca...with descriptions of the equipment insured, location and value. Alton made these motions orally at the August 25, 2017 status conference. Seneca represented that it has only written twenty-four such policies. Seneca alleges Alton Coal engaged in fraud in obtaining its insurance. Alton Coal denies the claim. A key issue has become what Alton Coal was supposed to disclose,when, and how. Seneca does not have written underwriting policies and claims Alton Coal violated its underwriting policies and procedures. Thus Alton Coal seeks to test Senecas testimony regarding its policies and procedures through production of the other highwall miner policies. Given only twenty four similar policies exist, the lack of other written material by which to discovery the policies, and the narrow scope of the requested information, the Court grants Alton Coals Motion.
