The record reflects the consent of Albion Mayflower Holdings and Matt and Holly Rasband to remove the case to federal court (ECF No. 2-3) but similar consent to remand the removed matter is not present. The other defendants in the action (Michael Baxter, who has answered the complaint, and The Temple Gate Trust) have similarly not stipulated or indicated consent to remand to state court. Accordingly, the court DENIES the motion to remand to state court without prejudice. The court will require the consent of all defendants to remand the case by stipulation.
