March 8, 2023 Opinion or Order Filing 11 DOCKET TEXT ORDER re #6 , #7 , #8 Summons. In the recent summons for Defendants Lumio Holdings, Lumio Inc., and Lumio HX, Plaintiff Cathy Alexander stated that an answer or motion under Federal Rule of Civil Procedure 12 must be filed within 30 days after service (not counting the day of receipt). However, the Federal Rules of Civil Procedure generally require a defendant to serve an answer within 21 days after being served with the summons and complaint. See Fed. R. Civ. P. 12(a)(1)(A)(i) (emphasis added). To avoid unnecessary confusion and duplication, the court will construe Alexanders stated timelinealthough inconsistent with the Federal Rules of Civil Procedureas the required timeline for an answer or motion under Rule 12. Defendants shall have 30 days after service of the summons (not counting the day of receipt) to file their answer(s) or Rule 12 motion(s). Signed by Judge Robert J. Shelby on 03/08/2023. (jl)
