DOCKET TEXT ORDER denying #24 Motion to Disqualify Counsel. Plaintiffs move to "disqualify" counsel Mark A. Nickel from representing Defendant Utah State Bar, arguing Mr. Nickel's Utah State Bar membership creates a conflict of interest. Plaintiffs also ask the court to require Mr. Nickel to register as an "agent of a foreign principal" under the Foreign Agents Registration Act (FARA), 22 U.S.C. 611 et seq., because he represents the Utah State Bar. Plaintiffs' motion is denied. The local rules in this district require attorneys to be members of the Utah State Bar. See DUCivR 83-1.1(a)(1). If all members of the Utah State Bar were ineligible to represent the organization, the organization would be left without counsel. Additionally, where the Utah State Bar is not a "foreign principal" as defined by FARA, Mr. Nickels representation of the Utah State Bar does not require him to register under FARA.
