DOCKET TEXT ORDER. Having carefully reviewed #12 Ex Parte Motion for Temporary Restraining Order and Preliminary Injunction, the court finds that Plaintiff has failed to justify an ex parte temporary restraining order under Federal Rule of Civil Procedure 65(b)(1). As the Supreme Court has explained, the issuance of ex parte temporary restraining orders is subject to "stringent restrictions" because "our entire jurisprudence runs counter to the notion of court action taken before reasonable notice and an opportunity to be heard has been granted both sides of a dispute." Granny Goose Foods, Inc. v. Teamsters, 415 U.S. 423, 43839 (1974). To the extent Plaintiff seeks an ex parte temporary restraining order, her motion is accordingly DENIED. (Her motion otherwise remains pending.)Plaintiff shall promptly serve Defendants with a copy of #1 Class Action Complaint, a copy of #12 Ex Parte Motion for Temporary Restraining Order and Preliminary Injunction and the supporting declaration and exhibits, as well as a copy of this docket text order. Once Plaintiff has served these documents on Defendants, she shall promptly file proof of service. Defendants shall file a response to #12 Ex Parte Motion for Temporary Restraining Order and Preliminary Injunction no later than seven days after receipt of service. Plaintiff may file a reply no later than three days after Defendants file a response.
