DOCKET TEXT ORDER. Having carefully reviewed #42 Plaintiffs' Second Motion for Temporary Restraining Order and #43 Plaintiffs' Third Motion for Temporary Restraining Order, the court again finds that Plaintiffs have failed to justify an ex parte temporary restraining order for the same reasons detailed in #20 Memorandum Decision and Order. In short, the adequacy of a state forum for purposes of Younger depends on whether "state law clearly bars the interposition of the federal statutory and constitutional claims," not on whether the state forum has been solicitous of such claims. Winn v. Cook, 945 F.3d 1253, 1258 (10th Cir. 2019). To be sure, in addition to their multiple motions for temporary restraining orders, Plaintiffs have submitted a veritable avalanche of filings, some of which can be understood to argue or imply that "special circumstances" obviate the application of Younger in this case. But the court has not found sufficient evidence in these filings to substantiate Plaintiffs' apparent position on this issue, particularly in an ex parte posture without the benefit of adversarial briefing. As the Supreme Court has explained, the issuance of ex parte temporary restraining orders is subject to "stringent restrictions" because "our entire jurisprudence runs counter to the notion of court action taken before reasonable notice and an opportunity to be heard has been granted both sides of a dispute." Granny Goose Foods, Inc. v. Teamsters, 415 U.S. 423, 43839 (1974). Plaintiffs' motions are accordingly DENIED. The court will not entertain further motions or requests for temporary restraining orders pending a ruling on Plaintiffs' Motion for a Preliminary Injunction. SO ORDERED. No attached document.
