DOCKET TEXT ORDER. The key contention underlying Plaintiffs' claims is that the State's requiring the placement of candidates who have submitted the specified number of signatures on the ballot for the Republican primary even when those candidates have been rejected by the Republican nominating convention contravenes Utah law and is unconstitutional. But however the undersigned might resolve these issues if they were presented as a matter of first impression, they are plainly controlled by the decisions of the Utah Supreme Court in Utah Republican Party v. Cox, 373 P.3d 1286 (Utah 2016), and the Tenth Circuit in Utah Republican Party v. Cox, 892 F.3d 1066 (10th Cir. 2018). The court has little difficulty concluding that the different procedural posture here does not provide a sound basis for disregarding the plain import of those decisions. And to the extent Plaintiffs attempt to repackage their constitutional arguments under the Guaranty Clause, the Supreme Court has repeatedly held that that provision of the Constitution is not justiciable. See, e.g., Rucho v. Common Cause, 588 U.S. 684, 718 (2019); Pacific States Tel. & Tel. Co. v. Oregon, 223 U.S. 118, 133 (1912); Luther v. Borden, 48 U.S. (7 How.) 1, 43 (1849).Having carefully reviewed #120 Report and Recommendation and #124 Plaintiffs' Objection to the Report and Recommendation, the court concludes that Plaintiff's objections are not well taken. The court accordingly OVERRULES the objections and adopts the Report and Recommendation. #83 Legislative Defendants' Motion to Dismiss, #84 Chief Justice Matthew Durrant's Motion to Dismiss, #85 State Defendants' Motion to Dismiss for Failure to State a Claim, #87 Defendants' Motion to Dismiss, and #88 Defendant Brian McKenzie's Motion to Dismiss are GRANTED and #7 Plaintiffs' Motion for Preliminary Injunction Under Rule 65 is DENIED. Plaintiffs' claims under the Guaranty Clause are dismissed as nonjusticiable. This action is otherwise DISMISSED for failure to state a claim upon which relief can be granted. SO ORDERED. DOCKET TEXT ORDER. To the extent Plaintiffs seek rescission of the referral of their motion for a preliminary injunction to Judge Bennett, discontinuation of automatic referrals to Judge Bennett, and "remand" of the action to the undersigned Article III judge, #92 Plaintiffs' Emergency Motion to Rescind Referral to Magistrate Judge, Remand to Article III Judge, and Expedite Resolution of Pending Preliminary Injunction is DENIED. Although a magistrate judge may not enter an order granting or denying a motion for a preliminary injunction under 28 U.S.C. 636(b)(1)(A), a magistrate judge may issue a report and recommendation regarding such a motion under 28 U.S.C. 636(b)(1)(B). As clarified in 79 DOCKET TEXT ORDER, the undersigned district judge expressly referred #7 Plaintiffs' Motion for Preliminary Injunction under Rule 65 to Judge Bennett under the latter provision. Once Judge Bennett issues his report and recommendation regarding this motion, Plaintiffs will have the opportunity to object under 28 U.S.C. 636(b)(1)(C) if they disagree with the disposition Judge Bennett proposes. Further, because the operative referrals in this case were made under Section 636(b)(1)(B) rather than Section 636(c), Plaintiffs' consent to those referrals is not required. Finally, the Supreme Court has held that the referral process authorized by Section 636(b)(1)(B) comports with Article III of the United States Constitution, see United States v. Raddatz, 447 U.S. 667, 683 (1980), and the undersigned has little difficulty concluding that Plaintiffs' remaining constitutional challenges to the referrals in this case lack merit. The undersigned sees no basis for Judge Bennett's recusal and has confidence that Judge Bennett will issue a report and recommendation addressing Plaintiffs' motion without unreasonable delay. But to the extent Plaintiffs seek Judge Bennett's recusal and expedited consideration of their motion for a preliminary injunction, #92 Plaintiffs' Emergency Motion to Rescind Referral to Magistrate Judge, Remand to Article III Judge, and Expedite Resolution of Pending Preliminary Injunction is hereby REFERRED to Judge Bennett for his consideration in the first instance.
