The court reviewed its expectations about the court's role and goals, the magistrate judge's role, and counsel's role and responsibilities, including meet and confer obligations and review of the court's MDL website for administrative and logistical questions. Discussion heard on the proposed MDL leadership structure, their experiences and qualifications. The court appointed interim class counsel and the court will issue an order. The court directed co-lead counsel to prepare an email list containing all members of the leadership and liaison team on the plaintiff's side, as well as the team on the defense side. The court directed counsel to use this email list when it is necessary to communicate with chambers to ensure representative counsel have all been notified and there are no ex parte communications. Discussion heard on the joint case management report, the proposed scheduling order and related issues. The court directed the parties to meet and confer regarding a potential discovery stay dispute that it became aware of at the hearing. Content and cadence of status reports and case management conferences were discussed, and the court identified proposed language depending on the resolution of the parties' further discussions about when the status reports will begin. The court anticipates reviewing the status reports and then determining, based on the parties' reports, whether a case management conference will be scheduled, and whether those conferences will be held in-person or by videoconference. The parties will a submit a proposed order addressing these issues.Additional discussion was held regarding notice of appearance of one counsel who has not yet appeared. Plaintiff's counsel also notified the court that it had reached settlement with one party and anticipates filing a motion regarding approval of that settlement.
