March 2, 2026 Opinion or Order Filing 43 DOCKET TEXT ORDER. Defendants move to stay the briefing of Plaintiff's motion for a preliminary injunction pending disposition of Defendants' motion to dismiss for lack of subject matter jurisdiction. See Dkt. No. 36. In its motion, Plaintiff seeks to enjoin the implementation of a recently enacted Utah statute pending disposition of this action. See Dkt. No. 32. In their motion to dismiss, Defendants argue that Plaintiff lacks standing to challenge the statute and that this action is barred by sovereign immunity. See Dkt. No. 35. This motion to dismiss will be fully briefed within a few days. And, because Defendants' motion to dismiss calls into question the court's subject matter jurisdiction over this action, the court necessarily must resolve the issues presented in that motion before considering Plaintiff's request for injunctive relief, whether or not it grants the requested stay. Furthermore, Plaintiff has twice failed to establish that the court has subject matter jurisdiction to consider the claims it seeks to assert. See Disability L. Ctr. v. Cox, 2025 WL 2050235 (D. Utah July 22, 2025), reconsideration denied, 2025 WL 3187347 (D. Utah Nov. 14, 2025). The court has carefully considered the arguments presented and the authorities cited by the parties and the circumstances of this litigationincluding that Defendants assert immunity from suit. And, having "balanc[ed] the competing interests on both sides," the court will not require Defendants to expend any additional resources on this action until Plaintiff demonstrates to the court's satisfaction that it has standing to bring the claims it seeks to assert in this action and that those claims are not barred by sovereign immunity. Commodity Futures Trading Comm'n v. Chilcott Portfolio Mgmt., Inc., 713 F.2d 1477, 1484 (10th Cir. 1983). #36 Defendants' Motion to Stay Briefing of Plaintiff's Motion for Preliminary Injunction is accordingly GRANTED. SO ORDERED.
