DOCKET TEXT ORDER: In #13 Memorandum Decision and Order Temporarily Granting Motion to Proceed in Forma Pauperis, and Ordering Plaintiff to File an Amended Complaint, Magistrate Judge Pead concluded that "Plaintiff's Complaint fails to meet the required pleading standards and offers nothing more than labels and conclusions" and that "Plaintiff lists claims for relief with no factual basis supporting them." Dkt. No. 13 at 4. Judge Pead consequently ordered Plaintiff to file an amended complaint. See id. The undersigned agrees with Judge Pead's assessment of the complaint. And because Plaintiff has so far failed even to state any claim, the court concludes that she has, a fortiori, failed to demonstrate that she is likely to succeed on the merits of any claim, as is required to obtain a temporary restraining order. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7 (2008); Stuber v. Lucky's Auto Credit, LLC, 478 F. Supp. 3d 1205, 1208 (D. Utah 2020). The court accordingly DENIES #10 Plaintiff's Emergency Motion for Temporary Restraining Order and Memorandum in Support (Tiered Relief). SO ORDERED. Signed by Judge Howard C.
