DOCKET TEXT ORDER requiring Plaintiff to pay an initial partial filing fee (IPFF) and incremental payments in accordance with statute until the full $350 filing fee is paid. See 28 U.S.C.S. 1915(b) (2025). The Court now follows up on its order, (ECF No. 4), granting Plaintiffs in forma pauperis (IFP) application, (ECF No. 3). Plaintiff must start by paying an IPFF "of 20 percent of the greater of... the average monthly deposits to [Plaintiffs inmate] account... or... the average monthly balance in [Plaintiffs inmate] account for the 6-month period immediately preceding the filing of the complaint." Id. To facilitate this, the Clerk of Court shall send--to the Utah State Correctional Facility's inmate accounting office--a Notice of Deficiency and Plaintiff's signed consent form, (ECF No. 3). Within thirty days of this Order, the Court must then receive Plaintiff's financial certificate, inmate-account statement, and IPFF that Plaintiff consented to have the inmate accounting office send to the Court. (Id.) If these items are not received within thirty days, the complaint will be dismissed, without further notice. Ultimately, Plaintiff is individually responsible to ensure that the inmate accounting office sends these items. No attached document. Signed by Magistrate Judge Dustin B. Pead on 01/12/2026. (kpf)
