DOCKET TEXT ORDER. Plaintiff filed this case using pseudonyms. Fed. R. Civ. P. 10(a) requires a complaint to name all the parties. Fed. R. Civ. P. 10(a); see also Fed. R. Civ. P. 17(a)(1) (requiring an action to "be prosecuted in the name of the real party in interest"). However, with respect to Jane Doe, DUCivR 10-2(a)(1) provides that "[i]f a party seeks to proceed under a pseudonym, the party must contemporaneously file: (A) a Motion to Proceed Under a Pseudonym, which uses the pseudonym and includes the justification for the use of a pseudonym under applicable law; and (B) under seal, a Notice of Intention to Proceed Under a Pseudonym - Full Names, which includes the full name of each party seeking protection." Further, DUCivR 10-2(c)(1) provides that "[i]f the case originates in this court, then the party must file the motion and notice contemporaneously with the case-initiating document." Finally, with respect to M.J.O., DUCivR 10-2(a)(2) provides: "Compliance with [DUCivR] 10-2(a)(1) is not required if a party is proceeding under Fed. R. Civ. P. 5.2(a)(3). However, the party must file under seal a Notice of Full Names - Minor, which includes the full name of each minor, deceased or living. The notice is required to allow the court to conduct a conflict check." Plaintiff failed to comply with those requirements. Therefore, on or before 05/12/2026, Plaintiff must fully comply with the requirements of DUCivR 10-2. If Plaintiff does not comply, this case may be dismissed for lack of subject-matter jurisdiction. Nat'l Commodity & Barter Ass'n, Nat'l Commodity Exch. v. Gibbs, 886 F.2d 1240, 1245 (10th Cir. 1989) ("Absent permission by the district court to proceed anonymously, and under such other conditions as the court may impose (such as requiring disclosure of their true identity under seal), the federal courts lack jurisdiction over . . . unnamed parties, as a case has not been commenced with respect to them.").
