The State Defendants' 7 motion to dismiss is GRANTED in p art and DENIED in part. Construing the complaint as raisinga Fourth Amendment claim of excessive force, the motion to dismiss this claim against Lora in his individual capacity is DENIED. The motion is otherwise GRANTED, and all remaining claims for relief are DISMISSED. The parties shall submit a proposed Discovery Schedule/Order pursuant to 26.1(b) on or before 9/30/2009.
