ORDER granting Lincare's 23 Motion in Limine to Exclude Expert Testimony and granting in part and denying in part 24 Lincare's Motion for Summary Judgment. 24 Motion for Summary Judgment is granted as to pltf's strict product lia bility claim. Accordingly, Count I of the complaint is dismissed. The motion is granted as to pltf's negligence claim alleging Lincare failed to inspect and discover an unreasonably and/or inherently dangerous defect or design in the oxygen sys tem and denied as to her negligence claim alleging Lincare failed to instruct her in accordance with the Manufacturer's Operating Manual.
