ORDER: DISMISSING WITHOUT PREJUDICE Complaint (replacement) (Doc. 6). By Order dated November 4, 2021, Plaintiff was informed she may petition the court for leave to amend her Complaint. The Court directed Plaintiff that, in doing so, she must explain why further Amendment would not be futile including pointing to a federal right to Medicaid funding for out-of-state transportation enforceable through a 1983 action or some other basis for this Courts jurisdiction. (Doc. 4 at 8.) Because Plaintiff did not file a motion for leave to amend along with her Complaint (Replacement), she has not complied with the Courts November 4 Order. Additionally, because there is no operative pleading in this case, Plaintiffs Emergent Motion (Doc. 7) and Emergent Motion (Doc. 8) are DENIED AS MOOT. Plaintiffs time to petition the court for leave to amend her Complaint, and to submit a proposed Amended Complaint, in accordance with the November 4 Order is extended to no later than December 10, 2021.
