ORDER Granting #1 Application for Leave to Proceed in Forma Pauperis and Denying Without Prejudice to Renew Plaintiff's #6 Motion for Summary Judgment. Plaintiff's Complaint is DISMISSED under 28 U.S.C. 1915(e)(2)(B)(ii) as against HireAbility and the Cannabis Control Board. The Complaint shall be filed without prepayment of the required fees. Plaintiff shall not be required to pay the fees for Service of the Complaint on Defendants Marble Valley Regional Transit District and Vermont DOL. Service of process shall be undertaken pursuant to 28 U.S.C. 1915(d) and, if necessary, shall be effected by the U.S. Marshals Service. Plaintiff is ORDERED to file a copy of his EEOC right to sue letter no later than June 2, 2023. Plaintiff's motion for summary judgment is DENIED without prejudice to renew.
