Defendant Cardow, Inc. and its agents are ENJOINED, PROHIBITED and PRECLUDED for 14 days from the date of this Order from using in any manner the mark "MEGANS BAY RUM" or any colorable imitation of the mark as a trade name, trademark, service mark, or domain name; or taking any action likely to cause confusion among consumers, customers, or the public in general with respect to the source of products and services offered for sale, distributed, or sold by Cardow, or with regard to there being a connection between Cardow Inc. and Bellows International. It is further ORDERED that Cardow, Inc. and its agents are ENJOINED, PROHIBITED and PRECLUDED for 14 days from the date of this Order from selling, distributing, or manufacturing any products in the U.S. Virgin Islands under the name "Magens Bay Rum." The provisions of this Temporary Restraining Order shall not go into effect until Plaintiff Islands Saints, LLC posts security with the Clerk of the Court in the form of a $10,000.00 bond (or its cash equivalent). An evidentiary hearing on Plaintiff's motion for a preliminary injunction shall commence promptly at 10:00 A.M. on Monday, October 28, 2024, in St. Thomas Courtroom 1. (DR) |
