Order DENYING Defendants' Joint Motion for Relief from September 29, 2009 Order #143 . A district court has discretion to grant and determine the amount of sanctions under its inherent power. See Fink v. Gomez, 239 F.3d 989, 991 (9th Cir. 2001). The Court determined that the appropriate measure of sanctions in this case is the amount of attorney's fees reasonably expended to prepare Defendants' Motion to Strike Plaintiff's Reply in Support of Its Motion for Preliminary Injunction #82 . These are the only costs that would not have been expended had Plaintiff included the newly-raised arguments in its initial brief. Because neither Mr. Samouris's #123 nor Ms. Boyer's #124 declaration included any costs to prepare the Motion to Strike, none of the costs described in those declarations will be awarded as sanctions. Accordingly, Defendants' Joint Motion is denied, the Court's September 29, 2009 Order #139 did not unintentionally omit any sanctions awards and will not be amended, and the amount of sanctions will be the sum from that order. ORDER: Before the Court is Defendants' Motion to Strike #82 and related Motion to Expedite #86 . Defendants seek to strike new facts and argument in Plaintiff's reply materials because they constitute an "ambush by reply." See, e.g., United States v. Romm, 455 F.3d 990, 997 (9th Cir. 2006). After review, the Court agrees that Plaintiff's supplemental reply materials were improperly filed but declines to strike them. Instead, Defendants are permitted to file new responsive materials no later than May 29, 2009; no reply materials from Plaintiff will be permitted. This removes any prejudice to Defendants and enables the Court to decide the preliminary injunction request after considering all the evidence. Accordingly, Defendants' Motion to Expedite #86 is GRANTED and Defendants' Motion to Strike #82 is DENIED. No later than June 9, 2009, Defendants shall file a declaration detailing the costs to prepare their initial responsive materials. The Court will review this declaration, determine what costs are reasonable, and assess this amount against Plaintiff as a sanction for causing Defendants to prepare additional materials.
