Filing 38 MINUTE ORDER re: #37 MOTION Defendant's Motion to Deny Class Certification : The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, Chief United States District Judge: The deadline for Plaintiffs to file a motion for class certification was previously set for June 15, 2018. Dkt. #32. Because June 15 is a Friday, if Plaintiffs filed their motion on that day it would be noted no earlier than July 13, 2018. LCR 7(d)(3); LCR 7(d)(6). On February 2, 2018, Defendants filed a Motion to Deny Class Certification and noted it for the earliest possible consideration. Dkt. #37. In conducting an action of this type, the Court has the authority to "determine the course of proceedings or prescribe measures to prevent undue repetition or complication in presenting evidence or argument." Fed. R. Civ. P. 23(d)(1). To reduce undue repetition and complication, the Court will re-note Defendants' Motion to July 13, 2018. Any motion for class certification filed by Plaintiffs shall be noted for July 13, 2018, as well, unless the parties can stipulate to a different briefing schedule. The Court encourages the parties to structure their briefing on these two motions to avoid undue repetition. (COB) |
