Because there is a presumption in favor of vacatur, defendants, interveno rs, and Swinomish will be the moving parties and may file motions regarding the appropriate relief for the APA violations discussed above. Only one motion may be filed in each of the three cause numbers at issue, C16-0950RSL, C17-1209RSL, and C18-0598RSL.
