Filing 25 RESPONSE TO ORDER TO SHOW CAUSE DECLARATION by Respondent Joseph Stanley Pigott (Pigott, Joseph) Modified on 7/1/2019 to correct title of document (PM). |
Filing 24 MINUTE ORDER terminating #23 MOTION for Joinder filed by Joseph Stanley Pigott. The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, Chief United States District Judge: On June 10, 2019, Respondent filed a document captioned as "Robin L. Crawford Joinder to This Case." Dkt. #23. To the extent this filing is intended as a motion for required or permissive joinder, the Court STRIKES the filing as not properly signed by Respondent, as required by Federal Rule of Civil Procedure 11 and this Court's Local Civil Rules. To the extent this filing is intended as a motion to intervene, the Court STRIKES the filing as procedurally improper. Ms. Crawford, the movant, did not file the motion. The motion is not "accompanied by a pleading that sets out the claim or defense for which intervention is sought," as required by Federal Rule of Civil Procedure 24(c). Lastly, the filing makes no effort to satisfy the requirements for intervention or explain why an apparent Texas state court eviction action between Ms. Crawford, an apparently unrelated party, and an apparently unrelated business entity has any factual or legal relationship to this case. Martinez, Chief United States District Judge: Respondent removed this action to this Court on May 7, 2019. Dkt. #1. The Court subsequently required Respondent to show cause, by June 12, 2019, why this Court had jurisdiction, why removal was proper, and why the action should not be remanded. Dkt. #15. On June 5, 2019, Petitioner filed a Motion to Remand, treating it as a response to the Court's Order to Show Cause and noting it for June 12, 2019. Dkt. #17. The Court did not require that Petitioner respond to the Court's Show Cause Order and the Court's local rules otherwise require that a motion for remand be noted no sooner than the fourth Friday following filing. LCR 7(d)(3). Accordingly, the Court renotes Petitioner's Motion to Remand (Dkt. #17) for June 28, 2019, in accordance with LCR 7(d). (CAO) |
