Martinez, Chief United States District Judge: On July 13, 2019, Plaintiff filed a Motion to Amend Complaint to Add Parties. Dkt. #30. Plaintiff filed it as an "Emergency Motion" and noted it for the Court's consideration on July 16, 2019. The Motion was not correctly noted in accordance with Local Civil Rule 7(d) and this Court has abolished "emergency motions." LCR 6(b) ("Motions to shorten time have been abolished."). Further, nothing in Plaintiff's filing demonstrates an existing "emergency" as Plaintiff merely seeks leave to amend to add two or more new defendants. Plaintiff also failed to "attach a copy of the proposed amended pleading as an exhibit to the motion or stipulation," as is required for motions to amend. LCR 15. From a brief review of Plaintiff's filing, it is not even clear to the Court that Plaintiff is asserting legal claims against the defendants he proposes to add. For all these reasons, the Court STRIKES Plaintiff's Motion to Amend Complaint to Add Parties (Dkt. #30) as procedurally improper. Plaintiff is not precluded from properly filing and noting a motion for leave to amend that complies with the applicable rules. (CAO) |
