September 24, 2021 Opinion or Order Filing 11 MINUTE ORDER re #7 , #8 , #9 , #10 : Petitioner's Emergency Motion for Temporary Restraining Order and supporting documents. The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, Chief United States District Judge: On September 24, 2021, Petitioner filed a motion for a temporary restraining order. Dkt. #7. Petitioner requests that the Court grant a TRO without notice to Respondent, who has not been served in this action. Federal Rule of Civil Procedure 65(b)(1) requires that Petitioner demonstrate that immediate and irreparable harm will occur before Respondent can be heard and certify "any efforts made to give notice and the reasons why it should not be required." This Court's Local Rules also require that "[u]nless the requirements of Fed. R. Civ. P. 65(b) for issuance without notice are satisfied, the moving party must serve all motion papers on the opposing party, by electronic means if available, before or contemporaneously with the filing of the motion and include a certificate of service with the motion." Local Rules W.D. Wash. LCR 65(b)(1). The Court has reviewed the motion and does not find that immediate and irreparable injury will occur before Respondent may be heard in opposition. Further, the motion does not detail any attempts to provide notice of Petitioner's intent to seek a temporary restraining order distinct from his attempts to serve this action. As such, the Court will not grant relief without providing Respondent an opportunity to respond. Accordingly, the Court directs Petitioner to serve Respondent, including a copy of the text of this order and the motion papers, as soon as possible and, if not possible, to provide notice and documents electronically no later than 12:00 p.m. on Monday, September 27, 2021. Respondent shall have until 12:00 p.m. on Tuesday, September 28, 2021, to file notice of intent to respond and, if so indicating, until 12:00 p.m. on Wednesday, September 29, 2021, to file a response.(CAO)
