MINUTE ORDER, Motions terminated: #38 Stipulated MOTION for Extension of Time to file Second Amended Complaint filed by Quinte Harris. The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, United States District Judge: On November 3, 2022, the Court issued an Order dismissing all claims against Defendant Microsoft with leave to amend within 30 days. Dkt. #35. On the last possible day for Plaintiff to amend, he filed the above Stipulated Motion for a two-week extension of the deadline. Dkt. #38. The Court did not immediately rule on this Stipulated Motion. Two weeks have now passed and Plaintiff has failed to file an amended complaint. A motion for relief from a deadline should, whenever possible, be filed sufficiently in advance of the deadline to allow the court to rule on the motion prior to the deadline. LCR 7(j). Parties should not assume that the motion will be granted and must comply with the existing deadline unless the court orders otherwise. Id. The Court finds that the parties did not file their stipulated motion in advance of the deadline nor did they provide a sufficient reason for failing to do so. In any event, even if the Court had granted the stipulation, Plaintiff has still failed to fail a timely amended complaint. Accordingly, Microsoft is properly dismissed as a Defendant in this case pursuant to Dkt. #35. The Court further notes that the parties have failed to file a timely Combined Joint Status Report and Discovery Plan as required by the Order at Dkt. #33. The Court DIRECTS the parties to file this Report or to otherwise update the Court as to the status of this case by filing a JSR on the docket no later than Thursday, December 22, 2022. (COB)
