The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, Chief United States District Judge: Under this Court's Local Rules, motions for temporary restraining orders without notice to and an opportunity to be heard by the adverse party are disfavored and will rarely be granted. It does not appear that Plaintiff is requesting a ruling on this Motion without notice. Unless the requirements of Fed. R. Civ. P. 65(b) for issuance without notice are satisfied, the moving party must serve all motion papers on the opposing party, by electronic means if available, before or contemporaneously with the filing of the motion and include a certificate of service with the motion. LCR 65(b). The motion must also include contact information for the opposing party's counsel. Id. The Court has reviewed the above Motion and finds that it is unclear if Plaintiff has served a copy of the Motion on the opposing party. The Court DIRECTS Plaintiff to immediately serve Defendant with a copy of his Motion, related declaration, Complaint, and a copy of this Minute Order, and to file with the Court a declaration of service when it has occurred. Defendant's obligations to respond under LCR 65(b)(5) do not start until service has occurred. (NA).
