Order [non-document] The Court requires further evidence from Defendant as to the applicable dates of the Conditions of Use attached to Defendant's Motion to Transfer Venue (Doc. No. #6 ). The Conditions of Use provided were "[l]ast updated: May 3, 2021." (Doc. No. 6-2 at Ex. A.) The Declaration of Jasmine Cummings in Support of Defendant's Motion states this is a "true and correct copy of the Amazon Conditions of Use." (Id. at 4.) However, the transactions alleged in the Complaint took place on November 29, 2021, November 30, 2021, December 22, 2021, January 16, 2022, and January 18, 2022. (Doc. No. 1-1, 4, 7, 9.) Defendant has not declared the dates in which the attached Conditions of Use were applicable. Therefore, within fourteen (14) days of this Order, Defendant is ordered to supplement its Motion with supporting documentation or affidavits regarding the Conditions of Use that were in place during the alleged transactions.
