| Filing 11 MINUTE ORDER RE: #10 Notice of Voluntary Dismissal (case) filed by Nicole Yount. The following MINUTE ORDER is made by direction of the Court, the Honorable Ricardo S. Martinez, United States District Judge: On December 20, 2023, Defendant Ulta Salon, Cosmetics & Fragrance, Inc., removed this case from King County Superior Court. Dkt. #1. Defendant filed an Answer to the Complaint on November 27, 2023. Dkt. #5. Plaintiff filed a Notice of Voluntary Dismissal on December 1, 2023, pursuant to Rule 41(a)(1)(A)(i). Dkt. #10. According to this Rule, a plaintiff "may dismiss an action without a court order by filing... a notice of dismissal before the opposing party serves either an answer or a motion of summary judgment." Fed. R. Civ. P. 41(a)(1)(A)(i). Because an Answer has already been filed, Plaintiffs Notice is procedurally incorrect, and the Court now STRIKES it. Nothing in this Order precludes Plaintiff from filing an amended notice under Rule 41(a)(1)(A)(ii) with the stipulation by all parties. (ALW) |
