The parties' #93 Second Stipulated Motion to Modify Case Schedule and Trial Date is DENIED without prejudice. As an initial matter, the parties seek to extend the expert disclosure deadline even though it has already passed. Retroactive relief from a deadline requires a showing of excusable neglect--something the parties have not demonstrated. See Fed. R. Civ. P. 6(b)(1)(B); Pioneer Inv. Servs. Co. v. Brunswick Assocs. Ltd. P'ship, 507 U.S. 380, 392 (1993). They also request a discovery motions deadline that is one day before the close of discovery. The Court's scheduling template provides 30 days between these dates so that any discovery-related motions (e.g., motions to compel disclosure) can be resolved prior to the close of discovery. Moreover, the requested dispositive motions deadline is just one month after the proposed discovery motions deadline. The Court could not guarantee that any discovery disputes would be resolved in time for the parties to draft their dispositive motions. Should the parties wish to renew their stipulated motion, they must submit a proposed amended schedule that adheres to the Court's scheduling template. See Dkt. No. #89 at 3. (NAW)
