October 19, 2010 Opinion or Order Filing 49 ** TEXT ONLY ORDER **On October 19, 2010, the court held a telephonic hearing on plaintiff's motion to compel discovery (dkt. 45 ). After hearing from both sides, the court denied the motion. Prior to plaintiff's motion, defendant had agreed to provide the relevant information on product design, including design changes. Pursuant to Fed.R.Civ.P. 26(b)(1), the information requested by plaintiff in its motion is not relevant to plaintiff's claims or defenses; such information is barely relevant to the subject matter involved in the action, and plaintiff certainly did not show good cause for disclosure. Pursuant to Rule 26(b)(2)(C)(iii), any hypothetical benefit of this information articulated by plaintiff--for damages, impeachment, whatever--is significantly outweighed by the burden on defendant of dragging defendant's response to "Antennagate" into a lawsuit that alleges infringement of structural patents.
