The motion by Fireye, Inc. is granted with respect to Lexingto n Insurance Company's claims that (1) Fireye breached a contract to which plaintiff was a third party beneficiary; (2) Fireye failed to provide adequate warnings with its Fireye flame monitor; and (3) Fireye designed its product with an unsafe default purge time.
