August 9, 2012 Opinion or Order Filing 30 ORDER that due to the nature of plaintiff's claim and the current posture of his claim, only limited scheduling is necessary in this case. If the order on the pending motion for preliminary injunction does not resolve this lawsuit, the parties may have 30 days after the order is entered to file a motion for summary judgment. Absent leave of court, no party may take discovery in this case. In the event that this case is not resolved by summary judgment motions, then the court will set a telephonic scheduling conference to calendar additional proceedings. March 6, 2012 Opinion or Order Filing 14 JUDGMENT entered dismissing this case as barred under Preiser v. Rodriguez, 411 U.S. 475 (1973), and Heck v. Humphrey, 512 U.S. 477 (1994). (PAO). (jef),(ps)
March 5, 2012 Opinion or Order Filing 12 ORDER that this case is DISMISSED as barred under Preiser v. Rodriguez, 411 U.S. 475 (1973), and Heck v. Humphrey, 512 U.S. 477 (1994). Plaintiff is obligated to pay the unpaid balance of his filing fees in monthly payments as described in 28 U.S.C. § 1915(b)(2). The clerk of court is directed to send a letter to the warden of plaintiff's institution informing the warden of the obligation under Lucien v. DeTella, 141 F.3d 773 (7th Cir. 1998), to deduct payments from plaintiff's tr ust fund account until the filing fees have been paid in full. Because plaintiff has failed to state a claim upon which relief may be granted, a strike will be recorded against him in accordance with 28 U.S.C. § 1915(g). This is plaintiff's third strike, which means that he will no longer be allowed to proceed in civil actions in forma pauperis unless he properly alleges that he is in imminent danger of serious physical injury. Signed by District Judge Barbara B. Crabb on 3/5/2012. (jef),(ps)
December 21, 2011 Opinion or Order Filing 4 ORDER on ifp request: Initial partial filing fee of $ 0.15 assessed. Initial partial filing fee due 1/11/2012. Signed by District Judge Barbara B. Crabb on 12/20/2011. (jef),(ps)
