Filing 78 OPINION AND ORDER denying 58 Motion for Partial Summary Judgment; granting in part and denying in part 44 Motion for Summary Judgment. Defendants' motion is granted with respect to plaintiffs' Fourteenth Amendment due process claim and plaintiffs' Fourth Amendment claim that defendants used unreasonable force in enforcing the writ of execution on 10/2/2014. The motion is denied in all other respects. This case will proceed to trial on plaintiff Roger Hoeppner's false arrest claim and his claims relating to the seizure and destruction of his cell phone and camera.
