See dkt. #56 . Under the court's scheduling template, the April 29, 2019 trial date allows the the court to give defendant until November 30, 2018 to file its summary judgment motion, if that's really what defendant wants. The court will allow defendant to file its response to plaintiff's motion on that same date because of Thanksgiving. These must be separate submissions. Finally, looking ahead, the court notes that defendant now has squeezed all available slack out of the schedule. Plaintiff will respond to defendant's November 30, 2018 summary judgment motion by December 21, 2018, and defendant's reply in support of its own motion will be due ten days later, on Monday, December 31, 2018. After the deadlines on the first two stays came and went without either side providing an update, the court lifted the stay, stating that "[n]o further stays will be granted in the absence of extraordinary circumstances." Dkt. 39. The parties do not acknowledge this order in their latest motion and they do not attempt to show that extraordinary circumstances justify a stay. Rather, their reason for a stay is the same as it was before: they want to attempt to negotiate a comprehensive settlement of this case and several other related cases pending in different districts. But they provide no basis for a belief that their negotiations will be more successful this time. The parties are free to engage in settlement discussions, but the parties have not shown that further delay is justified. The parties' motion for a stay, Dkt. #43 , is DENIED.
