March 19, 2019 Opinion or Order Filing 16 ** TEXT ONLY ORDER ** At the March 19, 2019 unrecorded telephonic preliminary pretrial conference with counsel for both sides, the court declined to set a full schedule in light of the pending motion to dismiss (dkt. #4 ) and motion for sanctions (dkt. #14 ). A response to the motion for sanctions is due by April 8, 2019, with any reply due by April 18, 2019. Discovery is stayed in this case is stayed until June 28, 2019 or until the court decides both pending motions, whichever comes first. As a placeholder, the court set jury selection and trial for November 16, 2020 at 9:00 a.m. Plaintiff, by counsel, announced that he plans to file a motion to strike the motion for sanctions because it was improperly served. Plaintiff should file this motion as soon as possible, but not later than March 25, 2019; briefing will follow on a 7/7 response/reply cycle. The court advised counsel that if a motion to strike is filed, then the court intends to increase the length of the discovery stay so that all of these motions are decided before discovery begins. February 21, 2019 Opinion or Order Filing 10 ** TEXT ONLY ORDER ** On February 13, 2019, defendant responded to plaintiff's class action complaint (dkt. #1 -1) by filing a motion to dismiss (dkt. #4 ) accompanied by a motion to stay discovery (dkt. #7 ), which plaintiff opposes (dkt. #9 ). This court hasn't held the preliminary pretrial conference yet, which means that discovery hasn't even begun. The clerk is directed to schedule a telephonic preliminary pretrial conference for mid-March, which will give the parties sufficient time to submit their Rule 26(f) report. Judge Conley's trial calendar for complex cases is densely packed, which means that we will end up calendaring this class action deeply enough into 2020--most likely October or November--to allow a brief front-end discovery stay without causing any additional delay. At the preliminary pretrial conference, the court will follow its routine in this set of circumstances by staying discovery unconditionally until the court rules on the pending motion to dismiss or until June 14, 2019, whichever comes first. In light of all this, defendant's motion to stay discovery is granted essentially by default to this court's ordinary practices in this situation. Signed by Magistrate Judge Stephen L.
