February 25, 2020 Opinion or Order Filing 114 ** TEXT ONLY ORDER ** The court is in receipt of a stipulation for court order and dismissal by defendants. (Dkt. #111 .) The stipulation is ACCEPTED. Pursuant to the terms of the Mutual Release executed by defendants, no insurer of any defendant has or can make any claim against any other defendant for amounts paid either in defense or indemnity relating to any claims of plaintiff Christina Iliadis. Such claims are released and extinguished pursuant to the terms of the Mutual Release. In light of this stipulation, this case is DISMISSED with prejudice and without costs, although the court retains jurisdiction to enforce the terms of the settlement, including any obligation by defendant Insperity PEO Services, L.P. under the terms of the agreement to issue a Form 1099 and Form W-2 to plaintiff. May 14, 2019 Opinion or Order Filing 34 ** TEXT ONLY ORDER ** In this civil action, plaintiff Christina Iliadis asserts claims under the Family and Medical Leave Act of 1993, 29 U.S.C. 2601 et seq., and the Pregnancy Discrimination Act of 1978, 42 U.S.C. 2000e(k), against her alleged employers defendants Four Lakes Education, Inc., K12 Inc. and McFarland School District, and two individuals apparently associated with K12, Nicholas Sutherland and Cynthia Worden. Before the court is defendants K12, Inc., Sutherland and Worden's motion to join Insperity PEO Services, L.P., as a defendant under Federal Rule of Civil Procedure 19(a). (Dkt. #27 .) These defendants contend that Insperity is a necessary party, since in an employment contract between Insperity and Iliadis, Insperity reserved a "right of direction and control over [plaintiff], including a right to hire or terminate." (Id. at 5; see also Defs.' Br., Ex. (dkt. #28 -1).) In response to the motion, plaintiff indicated that she did not oppose it (dkt. #27 ), and the other defendants -- McFarland School District and Four Lakes Education -- did not file a response by the due date, which the court will treat as a lack of opposition. As such, defendants K12, Sutherland and Worden's motion to join Insperity PEO Services, L.P. as a defendant (dkt. #27 ) is GRANTED as unopposed.
