Filing 12 ** TEXT ONLY ORDER **The parties have jointly requested that the court postpone the preliminary pretrial request until after it has decided the July 16, 2019 motion to dismiss, which will be under advisal to the court on August 16, 2019. The court's practice in this situation is to stay discovery for two months after the reply brief comes in, and to set a trial date a year after that. The court is willing to engage in this process in this case without requiring an immediate pretrial conference. Not later than August 2, 2019, the parties must report jointly to the court which of these trial dates they chose, all in 2020: October 19, October 26, or November 2. The court will set trial for that date and will enter a two-month discovery stay, to October 18, 2019. The court will hold the pretrial conference in late October, if necessary.
