** TEXT ONLY ORDER **Plaintiff has moved to dismiss Case Nos. 19-cv-482-jdp, 19-cv-483-jdp, 19-cv-484-jdp, and 19-cv-488-jdp without prejudice. The motion is GRANTED as to Case No. 19-cv-488-jdp. But Case Nos. 19-cv-482-jdp, 19-cv-483-jdp and 19-cv-jdp-484 raise the same claims that plaintiff already dismissed without prejudice in previous lawsuits. Compare Case No. 19-cv-482-jdp (alleging problems with spoiled food) with Case No. 19-cv-408-jdp (same), and Case No. 19-cv-483-jdp (alleging that prison staff used excessive force against him because he was a witness for another prisoner), with Case No. 19-cv-337-jdp (same), and Case No. 19-cv-484-jdp (alleging that prison staff failed to provide medical assistance when he hit his head), with Case No. 19-cv-139-jdp (same). Under Federal Rule of Civil Procedure 41(a)(1)(B), if plaintiff dismisses these cases a second time, the dismissal must be with prejudice, which means that he cannot bring the lawsuit again. Plaintiff may have until July 17, 2019, to inform the court whether he wants to dismiss the three cases with prejudice or continue to litigate them.
