Filing 18 ** TEXT ONLY ORDER **Plaintiff Carlos Lindsey's motion for extension of time to submit the $1.34 initial partial payment of the $350.00 filing fee, dkt. #17 , is GRANTED. Plaintiff may have until February 28, 2020 to submit the $1.34 initial partial payment. If by February 28, plaintiff fails to make the initial partial payment or show cause for his failure to do so, plaintiff will be held to have withdrawn this case voluntarily and the case will be dismissed without prejudice. Filing 15 ** TEXT ONLY ORDER **Plaintiff Carlos Lindsey asks for an injunction against defendant prison officials. Dkt. #7 & Dkt. #8 . He says that after he brought this action regarding his access to materials with which he has harmed himself (staples and plastic spoons), defendants retaliated against him by imposing hygiene restrictions and preventing him from keeping materials in his cell that he has never used to harm himself, such as paper products--including his legal papers. Dkt. #7 . He says these restrictions will prevent him from meeting pending court-imposed deadlines in two state-court cases. See Dkt. #11 ; Dkt. #11 -1; Dkt. #11 -2. But I have no authority over cases in other courts, and Lindsey has no pending deadlines in this case that would be affected by these restrictions. Lindsey also challenges his hygiene restrictions, but those are unrelated to the claims in this lawsuit. Accordingly, Lindsey's motion for an emergency injunction, Dkt. #7 , is DENIED, and his motion for an emergency telephone conference, Dkt. #8 , and his motion to expedite, Dkt. #9 , are DENIED as moot. Lindsey may file a separate lawsuit challenging his conditions of confinement, but if he files it in this court, it will be subject to dismissal under the terms of his filing bar. See Lindsey v. Johnston, No. 18-cv-398, 2018 WL 66062417 (W.D. Wis. Dec. 17, 2018). Signed by District Judge James D. Peterson on 1/30/2020. (nln),(ps) |
