Pursuant to Fed. R. Civ. P. 41(a)(1), this case is closed without further order of the court. (voc) |
Filing 6 Notice of Voluntary Dismissal by Plaintiff Alexandra Perz. (Peterson, Justin) |
Filing 5 ** TEXT ONLY ORDER ** Plaintiff has filed an amended complaint in response to this court's order asking for more information about whether plaintiff has satisfied the jurisdictional requirements in 28 U.S.C. 1332. The court is persuaded that the amended complaint adequately alleges all of the requirements for 1332. Signed by District Judge James D. Peterson on 2/03/2020. (voc) |
Filing 4 AMENDED COMPLAINT against All Defendants, filed by Alexandra Perz, (Attachments: #1 Exhibit A - Annual Report of WI Ideal Image, #2 Exhibit B - Employee Obligation Agreement, #3 Exhibit C - Letter from Atty. Beck) (Peterson, Justin) |
Filing 3 ** TEXT ONLY ORDER ** Plaintiff has filed a complaint in which she relies solely on 28 U.S.C. 1332 as a basis for jurisdiction, but her complaint doesn't meet the requirements of that statute. First, she hasn't properly alleged diversity of citizenship because she identifies her residence rather than her domicile, see Heinen v. Northrop Grumman Corp., 671 F.3d 669, 670 (7th Cir. 2012), and because she doesn't identify the members of defendant Ideal Image of Wisconsin, LLC or those members' states of citizenship, see Cosgrove v. Bartolotta, 150 F.3d 729, 731 (7th Cir. 1998). Second, she seeks only declaratory relief, but she doesn't explain why she believes that relief may be reasonably valued at more than $75,000. See Golin v. Neptune Mgmt. Corp., 704 F. App'x 591, 595 (7th Cir. 2017). Because this court has an independent obligation to determine whether it may exercise subject matter jurisdiction, see Carroll v. Stryker Corp., 658 F.3d 675, 680 (7th Cir. 2011), plaintiff may have until January 31, 2020, to file supplemental materials showing that she satisfies the requirements of 1332. If plaintiff fails to respond by January 31, the court will dismiss the case for lack of jurisdiction. Signed by District Judge James D. Peterson on 1/17/2020. (voc) |
