September 3, 2020 Opinion or Order Filing 3 ** TEXT ONLY ORDER ** Plaintiff has filed a civil action for declaratory and injunctive relief as a "compliance tester" under Title III of the Americans With Disabilities Act, alleging that websites and online reservation systems maintained by defendant fail to comply with 28 C.F.R. 36.302(e) by not identifying or allowing guests to reserve accessible guest rooms at the hotel and by not providing sufficient information regarding accessibility. Plaintiff has filed substantially similar complaints in 20 other cases in this court in the past two months. Given the Seventh Circuit's holding in Carello v. Aurora Policemen Credit Union, 930 F.3d 830, (7th Cir. 2019) concerning the Article III standing of ADA compliance testers with similar website accessibility claims for injunctive relief, this court is requiring plaintiff to show cause why her complaint should not be dismissed for lack of standing. See also Lujan v. Defenders of Wildlife, 504 U.S. 555, 560-65 (1992); Harty v. Greenwich Hospitality Group, LLC d/b/a Hampton Inn & Suites, 536 Fed. Appx. 154, 2013 WL 5779641 (2nd Cir. Oct. 28, 2013). Plaintiff's brief is due not later than September 24, 2020.
