September 16, 2020 Opinion or Order Filing 3 ORDER that plaintiff granted leave to proceed against Defendant Wisconsin Department Of Corrections. Lacy's Eighth Amendment claim is dismissed without prejudice. Lacy may have until October 7, 2020, to file an amended complaint that identifies who he believes was personally involved in depriving him of accommodations and explains why he believes that person or persons can be held liable under the Eighth Amendment. If Lacy doesn't respond by that date, I will dismiss the Eighth Amendment claim with prejudice. This court has an informal service agreement with the Wisconsin Department of Justice regarding service on the Wisconsin Department of Corrections and its employees. The court will wait to ask DOJ whether it will accept service until the court determines whether Lacy is proceeding on his Eighth Amendment claim. Signed by District Judge James D. September 10, 2020 Opinion or Order Filing 1 ** TEXT ONLY ORDER ** Plaintiff has responded to the court's order informing him that his complaint violates Federal Rule of Civil Procedure 20 and directing him to identify which claims he wants to pursue and which claims he wishes to dismiss without prejudice to refiling them at a later date. Plaintiff says that he wishes to proceed with two separate lawsuits: (1) defendant Sandra McCardle is refusing to treat a painful growth in Lacy's spleen and is not adequately treating a tumor in Lacy's liver that may be cancer; and (2) prison staff removed plaintiff from a cell that has a grab bar and an intercom button above the bed, both of which Lacy needs because he is confined to a wheelchair. Lawsuit (1) will proceed under Case no. 20-cv-473-jdp. The clerk of court is directed to assign a new case number for Lawsuit (2). Because Lacy doesn't identify the defendants for Lawsuit (2), the clerk of court should list the defendant as John Doe. I will screen both lawsuits in separate orders.
