March 3, 2021 Opinion or Order Filing 8 ** TEXT ONLY ORDER ** On April 17, 2019, during a lightning storm in New Richmond, two proximate houses containing defendant's CSST were damaged, ostensibly by the same lightning strike. Plaintiffs filed this one lawsuit, claiming that defendant's product was the cause of the damage to both houses. Defendant indicates that it may file a motion to sever the trials pursuant to Rule 42(b). So, at the March 3, 2021 unrecorded telephonic preliminary pretrial conference, the court set sequential trials for the two damaged houses, simply as a place-holder. There will not actually be two trials unless and until defendant files and the court grants a motion to sever. Signed by Magistrate Judge Stephen L. Crocker on 3/3/2021. (rks)
