Filing 2 COMPLAINT from case 19-cv-947-wmc, see pages 20-30; paragraphs 88-157 for claims, against All Defendants, filed by Walter Smith. (Case non-randomly assigned to District Judge William M. Conley.) (jef),(ps) |
Filing 1 ** TEXT ONLY ORDER entered in case 19-cv-947 ** Plaintiff Walter Smith has responded to the court's July 28, 2022, order, proposing alternative groupings of his lawsuits, and asking that the court sever Lawsuit 4 and file it under a new case number and allow him to voluntarily dismiss Lawsuits 5 and 6. (Dkt. # 16 .) This motion is GRANTED in part and DENIED in part. Smith's request to combine Lawsuits 1, 2 and 3 is DENIED, because Smith's proposed groupings would result in litigating multiple lawsuits under the same case number. It is GRANTED in that the claims in Lawsuits 5 and 6 are dismissed without prejudice, and Lawsuit 4 (Compl. (dkt. # 1 ) 88-157) is SEVERED. The claims in Lawsuit 4 shall proceed as case number 22-cv-459. Because Smith does not ask that the court alternatively sever his claims from Lawsuits 2 and 3, Smith's claims in Lawsuits 2 and 3 are dismissed without prejudice. Signed by District Judge William M. Conley on 8/24/2022. (jef) |
