Filing 9 Warden PLRA Letter. (voc),(ps) |
Filing 8 ** TEXT ONLY ORDER ** Plaintiff Karmin Benito Dearing filed a motion for assistance in recruiting counsel citing his confinement and mental health challenges in support. (Dkt. #7 .) This court has discretion to recruit pro bono counsel for a pro se litigant in certain limited circumstances, if the legal and factual difficulties of this case exceed the pro se litigant's abilities. See Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). However, before deciding the merits of such a request, the court must find that the litigant has made reasonable efforts to recruit an attorney on his own and has been unsuccessful. Jackson v. Cnty. of McLean, 953 F.2d 1070 (7th Cir. 1992). Dearing should be aware that this court generally requires litigants in his position to submit letters from at least three attorneys declining to represent them, or, if they received no response letters, a declaration attesting to whom they reached out for representation and when they sent the letter. Dearing has not made this showing, so his motion is DENIED without prejudice to Dearing's ability to renew it later in this lawsuit, if he (1) shows reasonable efforts to recruit an attorney on his own, and (2) he makes a more specific showing about why he needs an attorney to litigate this case. Signed by District Judge William M. Conley on 3/17/2023. (voc),(ps) |
