***TEXT ONLY ORDER*** Jesse Schworck has filed a motion to proceed in forma pauperis in this habeas case. According to his application, he earns $1500 a month from self-employment, has no other source of income, owns no property, and supports a wife and three minor children. As of May 4, 2023, he had $150 in checking or savings. Schworck is not incarcerated, so the court cannot use the formula set forth in 28 U.S.C. 1915(b)(1) to determine whether to allow him to proceed without prepaying the $5 filing fee. Nor can the court rely on indigency standards for non-prisoner plaintiffs in non-habeas cases. The filing fee in this case is just a fraction of the fee in those cases. Indeed, the fee in this case is only 0.3% of his reported monthly earnings. Based on those earnings, limited though they are, the court finds that Schworck can prepay the fee.
