March 1, 2024 Opinion or Order Filing 6 ** TEXT ONLY ORDER **Plaintiff requests a 30-day extension to pay the full $405 filing fee and reopen this case, or alternatively an order allowing him to use his release savings account to pay the fee. (Dkt. #5 .) The motion is GRANTED in part insofar as plaintiff may have until April 3, 2024, to submit the filing fee for this case. However, this court does not have the authority to order prison officials to use release account funds to pay the full filing fee. The Prison Litigation Reform Act requires prison officials to use a prisoner's release account to satisfy an initial partial payment of the court's filing fee if no other funds are available. Carter v. Bennett, 399 F. Supp. 2d 969, 936-37 (W.D. Wis. 2005); see 28 U.S.C. 1915(b)(1). Except for that initial partial payment, this court lacks "the authority to tell state officials whether and to what extent a prisoner should be able to withdraw money from his release account." Mosby v. Wommack, No. 08-cv-677, 2009 WL 2488011 (W.D. Wis. Aug. 12, 2009). Signed by District Judge William M. Conley on 3/1/2024. (lam),(ps)
