** TEXT ONLY ORDER **Petitioner brought this action under 28 U.S.C. 2254, and the court took the petition under advisement for screening. Petitioner moves to appoint counsel, asserting that his petition has merit and that this case is too difficult for him to handle without counsel. Dkt. #6 . This motion is DENIED without prejudice. In deciding whether to appoint counsel, the court must ask if petitioner can obtain justice without an attorney in view of his ability and the difficulty of the case, and if he would have had a reasonable chance of winning with counsel. See Howard v. Gramley, 225 F.3d 784, 794 (7th Cir. 2000). It's too early to make this determination; the court lacks an adequate record. If the petition survives screening, the court will order the state to file a response and the state court record.
