Filing 11 ** TEXT ONLY ORDER **Defendant removed from state court seven proposed class actions about a data breach that occurred in January 2024. The court asked the parties to address multiple issues, and the parties have responded. First the parties waive any right to recusal based on the presiding judge's status as a member of defendant. The court understands that any proposed class definition will exclude the presiding judge, his immediate family, and his law clerks. Second, the parties agree that defendant's amended notice of removal satisfies the "minimal diversity" requirement in 28 U.S.C. 1332(d) by alleging that defendant is a citizen of Wisconsin and its records show that "tens of thousands" of its patients live outside of Wisconsin. That is sufficient to allege minimal diversity, but defendant will need to come forward with evidence to support that allegation before the court can rule on any dispositive motion. See Lujan v. Nat'l Wildlife Fed'n, 497 U.S. 871, 888 (1990). Third, defendant says that consolidation of all seven cases is appropriate; plaintiffs ask the court to stay consideration of consolidation pending a motion to remand to state court, which plaintiffs say they will be filing within the next two weeks. The court will defer a decision on consolidation until June 26. If plaintiffs neither move to remand nor show cause why the cases should not be consolidated by then, the court will consolidate the cases and set the cases for a preliminary pretrial conference.
