Filing 3
**TEXT ONLY ORDER** Plaintiffs Glen and Terri Gilmer have filed a motion for leave to proceed without pre-paying the filing fee in this new civil case. In determining whether plaintiffs are indigent, I must consider the entirety of their financial picture. Park v. Hudson, 15-cv-2136, 2018 WL 8804822 at *1 (C.D. Ill. Oct. 29, 2018). This is a close call. Plaintiffs are retired with total income of $3,000 a month, but their expenses - a mortgage payment and a modest credit card bill - are $3,500 a month. The complaint refers to a motorcycle, but the motion does not, so the court assumes that the motorcycle was lost in the accident described in the complaint. And although plaintiffs have equity in a home, they have only $2,500 in checking, no savings, and no other investments. Their only other assets are their cars: a 10-year-old Subaru and a 27-year-old Chevy. Plaintiffs' motion to proceed without pre-paying the filing fee is GRANTED. Next the court will screen the complaint pursuant to 28 U.S.C. 1915 to determine whether the case must be dismissed because the complaint is frivolous or malicious, fails to state a claim on which relief may be granted, or seeks money monetary relief against a defendant who is immune from such relief. Once the screening process is complete, the court will issue a separate order. Signed by Magistrate Judge Andrew R. Wiseman on 6/11/2026. (jef),(ps)
